NAUTIC LOISIRS MEDITERRANEE and its subsidiaries: WGP NLM LES ISSAMBRES ; NLM WATER GLISS PASSION LA NARTELLE ; WGP PRE CLAOU
1. General provisions
Unless otherwise stipulated by contract, all orders for services placed with us and all contracts we handle are governed by these Terms and Conditions of Sale. They apply to all services, benefits and product sales provided by our companies.
Only quotations signed and returned bearing the handwritten words « BON POUR ACCORD » (agreed and accepted) will be taken into account for the organisation and delivery of the event on the agreed date and at the agreed location.
The services agreed for the event are detailed in the quotation attached to these terms and conditions.
2. Payment terms
Payments are made by cheque, cash, bank transfer or bank card.
A deposit of 30% of the total amount including tax must be paid when the service is confirmed, unless the contract provides otherwise (bill of exchange, purchase order, exchange voucher, voucher or counter-voucher, administrative payment order).
The balance is payable no later than the day of the service, or on presentation of the invoice, unless the contract provides otherwise (bill of exchange, exchange voucher, voucher or counter-voucher, administrative payment order).
NAUTIC LOISIRS MEDITERRANEE or its subsidiaries require the list of participants to be sent 48 hours before the date of the service. This list is used as the basis for invoicing. It may nevertheless be amended if further people join during the activity, subject to an additional payment. Should the number of participants be lower than the figure in the original quotation, the initial amount agreed when the quotation was accepted remains payable in full.
Should the services remain unpaid in full or in part 5 days after the invoice date, the debtor must pay NAUTIC LOISIRS MEDITERRANEE or its subsidiaries late-payment interest equal to three times the statutory interest rate.
The statutory interest rate applied is the rate in force on the day of delivery. The client is informed that, since 1 January 2015, the statutory interest rate has been revised every 6 months (see Order no. 2014-947 of 20 August 2014).
This penalty is calculated on the amount outstanding including tax, and accrues from the payment due date without any prior formal notice.
In addition to late-payment interest, any sum, including deposits, unpaid on its due date shall automatically give rise to a fixed indemnity of 40 euros in respect of recovery costs (see Articles 441-6, I paragraph 12 and D. 441-5 of the French Commercial Code).
3. Insurance
NAUTIC LOISIRS MEDITERRANEE holds public liability insurance under policy number AXA 0000010801025704.
The subsidiary WGP NLM LES ISSAMBRES holds public liability insurance under policy number GENERALI AU208608.
The subsidiary NLM WATER GLISS PASSION LA NARTELLE holds public liability insurance under policy number GENERALI AT842580.
The subsidiary WGP PRE CLAOU holds public liability insurance under policy number GENERALI AU415252.
4. Cancellation terms
NAUTIC LOISIRS MEDITERRANEE and its subsidiaries are the sole judges of whether or not a service can be delivered.
In the event of bad weather:
- If the weather conditions do not prevent the service from being delivered safely, the service will be invoiced in full. In accordance with Article L 121-20-4 of the French Consumer Code (Code de la consommation), tickets for parks, cinemas, ski passes and other tickets (shows, events, concerts, theatre, etc.) are not subject to a right of withdrawal. Please note that certain experiences, attractions, entertainment and ancillary facilities may only be available during certain seasons or under certain weather conditions, or may be closed, modified, delayed, unavailable or withdrawn without notice and without giving rise to any refund.
- If the weather conditions prove dangerous for carrying out the activities, NAUTIC LOISIRS MEDITERRANEE or its subsidiaries reserve the right to move the location of the service or to modify the activities.
- Where delivery is impossible due to force majeure, only the set-up costs will be invoiced by NAUTIC LOISIRS MEDITERRANEE or its subsidiaries (set-up costs, staff wages, travel expenses, compensation paid to service providers).
If the customer cancels, the service is invoiced in full.
It is nevertheless possible, subject to availability and provided that a minimum of 48 hours’ notice is given before the event, to postpone to a later date agreed by both parties (with the exception of water activities that include catering).
Should the number of participants increase, an additional payment will be applied. Conversely, should the number of participants be lower than the figure announced, the initial amount of the quotation remains payable.
5. Disputes
Consumer mediation
Where the customer qualifies as a consumer within the meaning of the introductory article of the French Consumer Code (Code de la consommation), any complaint must first be addressed to the customer service department of NAUTIC LOISIRS MEDITERRANEE or of the subsidiary concerned, by email to contact@waterglisse.com. In the event of an unfavourable reply, or of no reply within 60 days of the written complaint being sent, the consumer may refer the matter free of charge to the consumer mediator with jurisdiction over the professional:

Competent jurisdiction
Any dispute relating to our services shall, failing an amicable settlement, fall within the exclusive jurisdiction of the competent Commercial Court (Tribunal de Commerce), or Administrative Court in the case of public authorities.
